AN ORDINANCE relating to the 2008 Parks and Green Spaces Levy; authorizing the acquisition of property; amending the 2009 Adopted Budget and 2009-2014 Capital Improvement Program; establishing 2008 Parks Levy programs and projects; creating new budget control levels; and increasing appropriations in connection thereto; all by a threefourths vote of the City Council. WHEREAS, Ordinance 122749 authorized a proposition to be submitted to Seattle's voters that would levy for up to six years regular property taxes in excess of the limitation on levies in Chapter 84.55 RCW for the purposes of acquiring, developing, or restoring parks, recreation facilities, cultural facilities, green spaces, playfields, trails, community gardens, and shoreline areas, as well as providing for interim financing pending tax receipts, creating a citizens levy oversight committee, and creating a new fund; and WHEREAS, the proposed 2008 Parks and Green Spaces Levy (Levy) was approved by Seattle voters on November 4, 2008; and WHEREAS, Levy development and renovation projects proposed to receive funding in this ordinance include those that can move toward final design and construction most quickly; and WHEREAS, also proposed to receive funding in this ordinance are projects already underway but not yet complete due to a lack of funding from other sources, and the Levy allows funding for all phases of the selected project; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SEATTLE AS FOLLOWS: Section 1. The Superintendent of Parks and Recreation or his designee (Superintendent) is authorized, on behalf of the City of Seattle (City), to identify and evaluate parcels for purchase, transfer of jurisdiction, or voluntary conservation within designated green spaces and to conduct acquisition planning activities (including, but not limited to, studies, title searches, surveys, appraisals, and environmental assessments for the identified parcels). Section 2. The Superintendent is authorized, on behalf of the City, to conduct acquisition planning activities (including, but not limited to, assessments, appraisals, title searches, and preliminary negotiations) for any or all of the acquisition projects identified in the 2008 Parks and Green Spaces Levy (Levy) or recommended by the 2008 Parks Levy Oversight Committee. Section 3. The Superintendent is authorized, on behalf of the City, to acquire real property and real property rights within designated green spaces at current fair market value, and to execute such documents as he deems necessary or desirable to accomplish the acquisitions. Acquisitions will target critical properties in the following locations and in other designated Green Spaces: Arroyos Natural Area, Duwamish Head Greenbelt, East Duwamish Greenbelt, Northeast Queen Anne Greenbelt, Ravenna Woods, Thornton Creek Watershed, and the West Duwamish Greenbelt. Section 4. This BCL is funded by the 2008 Parks Levy Fund. 2008 Parks and K720023 2008 Parks The purpose of the 2008 Parks Recreation Levy Major Parks Levy Major Parks BCL Levy Parks is to support the Fund development or restoration (33860) of major neighborhood parks identified in the 2008 Parks Levy. This BCL is funded by the 2008 Parks Levy Fund. 2008 Parks and K720030 2008 Parks 2008 Parks Levy Forest & Parks Recreation Levy Stream Restoration BCL is to Levy Forest & support the work of the Fund Stream Green Seattle Partnership in (33860) Restoration leveraging work of the Cascade Land Conservatory to re-establish healthy urban forests on City-owned property. This BCL is funded by the 2008 Parks Levy Fund. 2008 Dept of TBD Support to The purpose of the Support Parks Transportation Multi-Purpose to Multi-Purpose Trails Levy Trails Budget Control Level (BCL) Fund is to appropriate funds from (33860) the 2008 Parks Levy Fund to the Transportation Operating Fund to support specific trail projects. Department of Burke-Gilman Trail Extension TC364830 This amendment shall operate for the purposes of increasing the base for the limit imposed by Subsection 4(c) of Ordinance 122863. Section 8. In accordance with RCW 35.32A.060, the foregoing appropriations are made to meet actual necessary expenditures of the City for which insufficient appropriations have been made due to causes that could not reasonably have been foreseen at the time of the making of the 2009 Budget. Section 9. Any act consistent with the authority and prior to the effective date of this ordinance is hereby ratified and confirmed. Section 10.
